The 2026 IAPP Global Privacy Summit, held in Washington, D.C. from March 30 to April 2, convened over 15,000 privacy and digital responsibility professionals to address the most pressing issues at the intersection of artificial intelligence (AI), data privacy, and regulatory enforcement. Topics covered at the Summit ranged from autonomous AI governance to state-level legislative trends. From the sessions and discussions I attended, my key takeaways included:
The Federal Trade Commission (FTC) Is Focused on Reactive Enforcement. FTC Commissioner Mark Meador stressed that the FTC is not looking to step in and tell companies how to run their businesses but, instead, will generally favor a case-by-case enforcement approach focused on reactively identifying harm, addressing it, and remedying it for consumers. The FTC’s priorities include AI-powered scams, age verification, and holding companies accountable for their privacy promises.
Data Minimization and Cookie Compliance Are Areas of Focus. Regulators are enforcing strict penalties for companies collecting and retaining data without immediate necessity. Similarly, cookie compliance emerged as a persistent risk area, with panelists noting that configuration failures, misclassified trackers, and abandoned marketing tags frequently lead to enforcement actions.
State Collaboration has Privacy Laws Converging. State legislators discussed their frequent collaborations with, and borrowing from, one another when drafting data privacy and AI laws. With the vast majority of states now having some form of privacy legislation, businesses that operate in multiple states are increasingly defaulting to the most restrictive frameworks (such as the California Consumer Privacy Act and the Colorado Privacy Act). While many interested parties seem open to a federal standard, the state legislators prefer such serves as a floor rather than a ceiling.
Agentic AI Demands a New Consent Framework. The rise of autonomous AI agents has resulted in traditional consent models being inadequate for protecting consumers. Given the increasing prevalence of AI agents, new approaches are needed to address novel liability questions around who bears responsibility when an AI agent causes harm.
Static Compliance is Outdated. A recurring theme was the insufficiency of traditional compliance models that rely on periodic assessments, one-time controls, or written policies. Speakers emphasized that AI governance requires ongoing monitoring, adaptive safeguards, and real-time oversight, reflecting a shift toward compliance as a continuous process rather than a fixed state.
The overarching message I took from the Summit is that despite the currently fragmented legal and regulatory landscape, regulators, legislators, and enforcement agencies are moving beyond policy drafting and into operational scrutiny. As the privacy landscape becomes increasingly more dynamic, companies that proactively treat compliance as a living, cross-functional discipline will be best positioned to manage risk associated with their data and technology.
